General Terms and Conditions of Sale
GENERAL TERMS AND CONDITIONS OF SALE – MJ BAZAR
These General Terms and Conditions of Sale (hereinafter "GTC") apply to all sales concluded between MJ BAZAR, a company specializing in the wholesale of perfumes, cosmetics and derivatives (hereinafter "the Seller"), and any professional buyer (hereinafter "the Client"), as defined in the preliminary article of the Consumer Code.
By placing an order, the Customer acknowledges having read and accepted without reservation these Terms and Conditions, which prevail over any other document.
1. Customer Status
MJ BAZAR sales are exclusively reserved for professionals.
The Client expressly acknowledges acting within the scope of their professional activity, even if they are not registered (no SIRET number). They waive any rights granted to consumers.
The Seller reserves the right to refuse or cancel any order if it considers that the Customer does not meet the eligibility criteria for the professional offer.
2. Minimum order
All orders must reach a minimum amount of €100 excluding VAT and delivery charges.
Below this amount, the order may be automatically refused or cancelled without compensation.
3. Price and payment terms
Prices are expressed in euros excluding tax (HT).
Unless otherwise specified, full payment is due upon ordering via the available payment methods (credit card, bank transfer, cash, etc.).
Any delay in payment will result, without prior notice:
late payment penalties equal to three times the legal interest rate,
a fixed compensation of €40 for recovery costs (art. L441-10 Commercial Code),
the immediate suspension of ongoing deliveries.
4. Delivery and transfer of risk
Delivery times are indicative and do not constitute a firm commitment.
The goods travel at the Customer's risk from the moment they are handed over to the carrier. The Seller shall not be liable for any delay or loss.
5. Claims – Returns
Any claim (missing, damaged or non-compliant product) must be reported within 48 hours of receipt, with supporting photos, by email to the contact address provided.
No returns will be accepted without prior written authorization from MJ BAZAR.
Products that have been opened, used or refurbished by the Customer will not be accepted for return, exchange, or refund.
6. Exclusion of the right of withdrawal
In accordance with Article L221-3 of the Consumer Code, no right of withdrawal applies to professional purchases.
The Customer acknowledges that the order was placed for professional purposes (resale, transformation, commercial use) and expressly waives any right of withdrawal, cancellation or refund, except with the exceptional written agreement of MJ BAZAR.
7. Responsibility
MJ BAZAR cannot be held responsible for misuse, resale or reconditioning of products by the Customer, nor for the failure of their business project.
No indirect damages (loss of revenue, damage to image, etc.) may be claimed from the Seller.
8. Retention of Title Clause
The goods sold remain the exclusive property of MJ BAZAR until full payment, including principal and any additional charges.
In the event of non-payment, the Seller may repossess the products at the Client's expense, without prior notice.
9. Disputes – Applicable Law
These Terms and Conditions are governed by French law.
Any dispute relating to their interpretation or execution shall be under the exclusive jurisdiction of the Commercial Court of Paris, even in the event of multiple defendants or third-party claims.
Acceptance
Any order implies the Client's full and unreserved acceptance of these Terms and Conditions.
No special conditions, including purchase conditions, may prevail over these terms, unless accepted in writing by MJ BAZAR.
